1. Scope

This Policy explains how GEMx LLC collects, uses, and discloses information for the FieldCast website, app, weather and field tools, subscriptions, support, and related communications. FieldCast uses shared AgrowKnow identity, workspace, field, and billing infrastructure. This Policy covers that processing when it supports FieldCast; other products may provide additional notices for their own services.

We initially offer FieldCast in the United States. Information about a field or business may also be personal information when it identifies or can be linked to an individual. Publicly available maps do not make your account's association with a farm, your private records, or your management choices public.

Some information is required to create an account or supply a selected feature. Optional profile, location, and communication choices are identified in the relevant interface. Do not send sensitive information unrelated to the Service in uploads or support messages.

Stripe processes payment-card details through its payment interface. FieldCast receives payment and billing records and limited payment-method information; full card numbers and card security codes are not handled by FieldCast's application backend. Stripe also processes information for its own payment, fraud-prevention, and legal purposes under its privacy notice.

When Google sign-in is enabled and you choose it, we receive your Google account identifier, email address, and basic profile information to authenticate you and complete your account. This integration does not request access to your Gmail messages, Drive files, or contacts. Google receives information about the sign-in and handles its own account information under its policies.

3. Location and third-party map requests

You can draw, find, or upload a field without granting device-location access. Using a current-location control may request your browser or device's location permission. You can withdraw that permission in browser or device settings. Turning it off does not delete saved field coordinates or prevent FieldCast from using those coordinates to provide field-specific services.

Weather, imagery, reverse-geocoding, and crop-data requests can disclose selected coordinates, sample points, or map areas to their providers. When your browser contacts a provider directly, that provider also receives connection information such as your IP address. Providers include Esri for basemaps, BigDataCloud and the U.S. Census Bureau for geographic context, and relevant weather or agricultural sources such as NOAA/NWS, NASA, USDA, and EPA. Other environmental layers may use the U.S. Drought Monitor and Canadian weather sources. These sources may process requests under their own policies.

FieldCast uses device location for user-initiated map positioning and does not continuously track your movements in the background.

4. Shared accounts, service providers, and other disclosures

We disclose information as needed in the following circumstances:

We do not sell personal information or identifiable private farm records, share personal information for cross-context behavioral advertising, or use private Customer Data to train general-purpose AI models. We do not provide sponsors with field data merely because they fund access. Any proposed separate research use or change to these limits requires a clear advance disclosure and your separate affirmative permission. Declining that optional permission does not reduce access to the Service you purchased.

5. Browser storage and tracking choices

FieldCast stores sign-in sessions, preferences, and cached application information on your browser or device. Payment, sign-in, hosting, font, and map providers may also use storage or process connection information for their functions. The marketing site loads Google Fonts directly. Clearing browser storage may sign you out or reset preferences; it does not erase server-held account or field records.

FieldCast does not use third-party advertising pixels or track your activity across unrelated websites for targeted advertising. It does not currently change its operation in response to a browser's legacy Do Not Track setting. Where applicable law requires recognition of a legally valid opt-out preference signal, we will honor that signal for covered processing.

6. Email and contact choices

Daily weather summaries are enabled by default for eligible accounts; weekly summaries are optional. Account settings lets you change the enabled cadence, selected fields, timing, and time zone. A weather email's unsubscribe link turns off the identified cadence. You can still receive essential security, account, billing, or legal messages.

Marketing preferences are separate from service-email settings. Accepting Terms or providing a phone number does not give blanket permission for unrelated marketing, automated marketing calls, or texts. Marketing messages will provide the applicable unsubscribe mechanism. We retain limited suppression information as needed to honor an opt-out.

7. Retention, cancellation, and deletion

We keep information for as long as reasonably necessary for the stated purposes, considering active account and workspace use, support needs, security, legal obligations, and disputes. Subscription cancellation or trial expiration changes access and does not automatically delete field records. We retain limited billing, tax, payment-dispute, security, and audit records when necessary even after a deletion request; those records are not a reason to keep unrelated product information indefinitely.

Contact support@gemxag.com to request access, correction, an export, or deletion. Specify whether you want to remove FieldCast data or delete your shared AgrowKnow account. We verify requests appropriately and explain the effects on other products, subscriptions, and records maintained by an organization or other authorized users. We do not require you to send passwords or full payment-card numbers. A request involving another person's information or an organization's shared records may require an additional permission check.

We assess retention by information category. Account and field records are kept while needed for your account or an authorized shared workspace, unless a valid deletion request or another applicable requirement calls for earlier removal. Payment and tax records are retained for applicable accounting, tax, and legal requirements and to resolve related disputes. Security and audit records are retained only as needed to investigate incidents, prevent misuse, resolve disputes, or meet legal obligations. Limited suppression records may be retained to honor communication opt-outs.

We process verified deletion requests within applicable legal deadlines. If information must be retained, we explain the relevant categories and reasons, subject to legal restrictions. An optional account-recovery period, if offered, will be explained when requested and will not override applicable deletion rights. Residual backup copies remain protected and are removed through the applicable backup-retention process; they are not used for routine product activities. If a backup is restored, applicable deletion requests must be reapplied. We do not promise that subscription cancellation immediately erases all records or that every category has the same retention period.

8. Privacy rights

Depending on where you live, the capacity in which you use the Service, and applicable law, you may have rights to confirm processing, access or obtain a copy of personal information, correct inaccuracies, delete information, obtain a portable copy, withdraw consent, or opt out of specified sales, targeted advertising, or profiling. Some jurisdictions provide rights concerning sensitive information and authorized agents. These rights may have legal exceptions.

Send requests to support@gemxag.com. We will verify identity or authority only as reasonably necessary, respond within applicable legal deadlines, and explain any denial and available appeal. Where an appeal is available, reply with “Privacy appeal” and identify the decision you want reviewed. You may also contact the appropriate privacy regulator or state attorney general. We will not unlawfully discriminate against you for exercising privacy rights.

9. Security, processing locations, and children

We use safeguards intended to protect information, including authenticated access and workspace permissions. No system can guarantee absolute security. Please protect your account and notify support@gemxag.com of suspected misuse. We handle security incidents and required notices under applicable law.

We operate in the United States and use providers that may process information in other countries where they and their subprocessors operate. This Policy does not promise U.S.-only storage.

FieldCast is a general-audience weather and agricultural planning service and is not directed specifically to children under 13. We do not knowingly collect personal information from children under 13 without legally required parental notice and verifiable consent. If we learn that we have collected a child's personal information without those protections, we will take steps to delete it unless retention is permitted or required by law. A parent or guardian may contact support@gemxag.com with questions or a request concerning their child's information.

10. Changes and contact

We will post the effective date of this Policy and provide appropriate notice of material changes. We will obtain consent where required before materially different processing. Continued use alone does not override legally required consent or authorize retroactive changes to our prior privacy promises.
